Religious workers (R-1)
An R-1 Visa allows applicants to work for an organization recognized as a religious non-profit organization as a minister or professional in a religious occupation. The applicant is required to show that he or she, for the 2 years immediately preceding the time of the application for admission, has been a member of a religious denomination of a bona fide nonprofit religious organization in the United States. The initial approved period of stay is 30 months, after which it can be extended for another two years.
Petition Process for the R-1 Visa applicant:
- The potential employer must submit a Form I-129 including the R-1 Classification Supplement signed by the employer
- Proof must be shown that the religious worker is a member of a religious denomination of a bona fide nonprofit religious organization, and has been for at least 2 years prior to filing the application.

If the religious worker will be working as a minister, he/she must provide:
- A copy of the certificate of ordination
- Proof of qualification to be a minister (i.e. completed theological education, transcripts, curriculum, theological institution’s accreditation)
Family of R-1 Visa Holders
A spouse and unmarried children under the age of 21 may be enjoined under an R-2 classification. Spouses and children with an R-2 Visa may not work but may study.
