Family-Based Immigration

 

1.   Who can petition for family visas? 

U.S. citizens and lawful permanent residents (green cards holder).

Note: Lawful permanent residents can only petition for their spouse and unmarried children.

 

2.   What is the preference order for family based petitions? 

 First Preference - Unmarried sons or daughters (over age 21) of U.S. citizens.

 Second Preference - 

- (2A) Spouses and unmarried children (under age 21) of permanent residents; 

- (2B) Unmarried sons and daughters (over age 21) of permanent residents.

 

 Third Preference - Married sons and daughters of U.S. citizens. 

 Fourth Preference - Brothers and sisters of U.S. citizens. 

 

3.   Are there family members that receive priority? 

   Yes, spouses and unmarried children under 21 years old of U.S. citizens qualify as immediate relatives and receive priority over other family members.

 

4.  What services does this law firm provide for filing family based petitions?

Client can set up an appointment for a free initial consultation. 

Attorney will analyze the case and advise client of the legal requirements. If the client retains our firm, the client will be asked to provide relevant documents for the preparation of the petition. 

Once the documents are received, we will review and verify the information/documents provided, compile the supporting documents, and complete the petition as soon as possible. 

The completed forms will be signed by client and will then be filed with the appropriate Bureau of Citizenship and Immigration Services.
