Process for EB5 Immigration

For overseas petitioners who will be petitioning with a regional center, the process will be:

Step 1

The applicant and the regional center execute an investment partnership agreement and subscription agreement. Upon submission of investment fund by the applicant, the investment process is completed. The attorney works with the applicant to submit application related documents to the USCIS.  The USCIS accepts application and starts its reviewing process. This process usually takes 1-3 months.

Step 2

After immigration application is approved, the applicant will receive approval notice and documents from the USCIS.  The attoreny will then submit interview application at the U.S. Consulate at Guangzhou. The U.S. Consulate at Guangzhou will inform applicant to come to the Consulate for immigration interview, physical examination and criminal record background check, etc. This process usually lasts for 2-3 months.

Step 3

After the interview is passed, U.S. Consulate will issue conditional green card. Applicant shall enter the U.S. within 180 days upon acquisition of the green card.
